1. Acceptance of Terms

By creating an account on Eatoon (the "Service"), you unconditionally accept these Terms of Service and the Privacy Policy. If you do not accept these terms, you must not use the Service.

2. Service Description

Eatoon is an online platform for organizing potluck dinners. The Service is provided by Dukiwi SA, Grand-Rue 18, 1470 Estavayer-le-Lac, Switzerland.

3. Service Provided "As Is"

The Service is provided "as is" and "as available", without warranty of any kind, express or implied. Dukiwi SA does not warrant that:

  • the Service will be uninterrupted, error-free, or bug-free;
  • results obtained through the Service will be accurate or reliable;
  • the Service will meet your specific requirements.

You use the Service at your own risk.

4. Limitation of Liability

To the fullest extent permitted by applicable law, Dukiwi SA shall not be liable for:

  • any loss of data, service interruption, or indirect damages;
  • any harm resulting from fraudulent or improper use of the Service by a third party;
  • any damages related to dietary issues, allergies, or dietary restrictions not respected at a meal organized through Eatoon — each host and guest is responsible for their own dietary choices;
  • any loss of profit, goodwill, or data resulting from use or inability to use the Service.

5. Use of Data by Dukiwi SA

By creating an account, you agree that Dukiwi SA may use your data (name, email address, usage behavior) for the following purposes:

  • Providing and improving the Service;
  • Targeted advertising and personalized marketing communications (by email or through the Service);
  • Statistical analysis and market research for internal use;
  • Development of new Dukiwi SA products and services;
  • Sharing with Dukiwi SA group companies for the same purposes.

You may object to the use of your data for marketing purposes at any time by contacting info@dukiwi.com.

6. User Obligations

You agree to:

  • Provide accurate information when creating your account;
  • Not create fake events, spam, or abusive content;
  • Not attempt to circumvent the Service's security measures;
  • Be at least 16 years old to create an account.

7. Suspension and Termination

Dukiwi SA reserves the right to suspend or delete any account without notice in case of violation of these Terms, or abusive or fraudulent use of the Service.

You may delete your account at any time from your profile. Deletion permanently removes all your data.

8. Changes to Terms

Dukiwi SA may modify these Terms at any time. Changes take effect upon publication on this page. Continued use of the Service after changes constitutes acceptance of the new terms.

9. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the canton of Fribourg, Switzerland.
